TailgateTime – Terms of Service

Welcome to TailgateTime! These Terms of Service (“Terms”) govern your access to and use of the TailgateTime mobile application, website, and related services (collectively, the “Service”), provided by V&S Ventures LLC (“we,” “our,” or “us”).

By creating an account, downloading, or using TailgateTime, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

• You must be at least 13 years old to use TailgateTime.
• If you are under 18, you must have permission from a parent or guardian.
• By using TailgateTime, you confirm you have the legal capacity to enter into these Terms.

2. Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate information when creating your account.
• You are responsible for all activity that occurs under your account.

3. Acceptable Use

You agree not to:

• Use TailgateTime for unlawful, harmful, or abusive activities.
• Post content that is offensive, obscene, hateful, or infringes on others’ rights.
• Attempt to hack, disrupt, or reverse-engineer the Service.
• Use TailgateTime in a way that could harm its availability or security.

We reserve the right to remove content or suspend accounts that violate these rules.

4. User Content

• You retain ownership of the content you post (e.g., messages, photos).
• By posting, you grant us a limited, non-exclusive license to host, display, and distribute that content solely for operating the Service.
• You are solely responsible for the content you share.

6. In-App Features & Third Parties

• Some features may involve third-party integrations (e.g., social sharing, payments).
• We are not responsible for third-party services or content.

7. Termination

• You may delete your account at any time in the app.
• We may suspend or terminate your account if you violate these Terms.
• Termination does not limit our right to pursue remedies for violations.

8. Disclaimers & Limitation of Liability

• TailgateTime is provided “as is” and “as available,” without warranties of any kind.
• We are not responsible for:
  • Events, tailgates, or interactions arranged through the app.
  • Losses resulting from unauthorized account access.
• To the fullest extent permitted by law, our liability is limited to the amount you paid (if any) for the Service in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless V&S Ventures LLC and its affiliates from any claims, damages, or expenses arising out of your use of TailgateTime or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or on our website. Continued use of the Service after changes take effect means you accept the updated Terms.
